AR-1 Petition of Notice and Protest filed

The AR-1 zoning ordinance is coming up for a final reading and vote on 9/14/2016 during that evenings Council meeting.

The AR-1 is an ordinance that would permit a developer to build age restrictive housing on 2 acres of land with a potential density of 30 units / acre. Detailed information and concept plans can be found in previous articles,  AR-1 and  Back to the planning Board.

In response to having passed the first reading in June, a group of concerned citizens formed a group called Protect Glen Rock. The group is made up with several people that live in the area of the proposed properties at 569 Prospect St.

The group officially filed an Objection Petition to the Glen Rock Borough Clerk on September 7th. This petition included 9 notarized Notice and Protest petitions which equals to more then 20% of the owners within the 200 feet of the proposed site.

40:55D-63.Notice and protest

    •  Notice of the hearing on an amendment to the zoning ordinance proposing a change to the classification or boundaries of a zoning district, exclusive of classification or boundary changes recommended in a periodic general reexamination of the master plan by the planning board shall be given prior to adoption.
    •  A protest against any proposed amendment or revision of a zoning ordinance may be filed with the municipal clerk, signed by the owners of 20% or more of the area either
      1. (1)  of the lots or land included in such proposed change, or
      2. (2)  of the lots or land extending 200 feet in all directions therefrom inclusive of street space, whether within or without the municipality. Such amendment or revision shall not become effective following the filing of such protest except by the favorable vote of two-thirds of all the members of the governing body of the municipality.

What this will do is make the final read a super-majority vote. This means that 2/3rds of the council has to vote in favor of the proposed zone. In addition, the mayor can not break the vote. If it becomes a tie, the vote fails.
